Wage Compliance Requirements for Contractors Working with MHA


MHA is committed to full compliance with all applicable federal and state labor laws. Contractors performing work at MHA properties must comply with the wage requirements that apply to the specific project and funding source.

Failure to comply with wage laws may result in withholding of payments, contract termination, reporting to regulatory agencies, and disqualification from future work.


1. Federally Funded Projects (HUD Properties – Group A)


Work performed at HUD-funded public housing properties (including AMP1 – Golden Gate Village and AMP2 sites) may be subject to federal labor standards, including:


Davis-Bacon and Related Acts (DBRA)

Applies generally to construction, rehabilitation, and certain maintenance contracts exceeding $2,000 when federal funds are involved.


Contractors must:

  • Pay no less than the applicable federal prevailing wage rates
  • Pay fringe benefits as required by the wage determination
  • Submit certified payroll reports upon request
  • Comply with apprenticeship and classification rules


Wage determinations are issued by the U.S. Department of Labor. Please note: Where California Prevailing Wage rates for the same positions are higher, California state wages apply.

2. State- or Non-HUD-Funded Projects (Group B Properties)

Projects funded through State programs, local public funds, or certain grants may be subject to California Prevailing Wage Law administered by the California Department of Industrial Relations (DIR).

Contractors must:

  • Be registered with the California DIR (when required)
  • Pay no less than the applicable California prevailing wage rates
  • Submit certified payroll records using DIR-compliant systems
  • Comply with apprenticeship requirements

Note: California prevailing wage requirements may apply even when federal Davis-Bacon does not.


3. Mixed-Funding Projects

Some projects may involve both federal and state funding. In such cases, the more restrictive wage requirement may apply. The solicitation and contract documents will identify the governing wage standard.


4. Contractor Responsibility

It is the contractor’s responsibility to:

  • Review the solicitation and contract documents carefully
  • Confirm whether federal or state wage laws apply
  • Ensure subcontractors are also compliant
  • Maintain accurate payroll records
  • Respond promptly to MHA compliance requests


MHA reserves the right to request certified payroll records and supporting documentation to verify compliance.
